## Acceptance and authority

These Terms of Service govern access to and use of the Hello Alex website, applications, and AI-assisted communication services (the Services). By creating an account or using the Services, you agree to these Terms and the Privacy Policy.

If you use the Services for a company or other organization, you represent that you have authority to accept these Terms for that organization. You must be at least 18 years old or the age of majority where you live.

## The Services

Hello Alex provides configurable tools for phone answering, routing, scheduling, intake, messages, workflow automation, reporting, and related integrations. Available features depend on the selected plan, configuration, region, providers, and service status.

We may improve, replace, limit, or discontinue features. We will use reasonable means to communicate material changes that significantly affect an active paid service.

## Accounts and access

- Provide accurate account, business, billing, and contact information.
- Keep credentials secure and use appropriate permissions for team members.
- Notify support promptly if you suspect unauthorized access or misuse.
- Remain responsible for activity performed through your account and connected integrations.

## Customer responsibilities

You control your workflows, instructions, data sources, phone numbers, audiences, and integrations. You are responsible for reviewing configurations before launch and for using outputs appropriately.

- Provide accurate, lawful instructions and content and maintain the rights needed to use them.
- Give required notices and obtain consent for recordings, monitoring, messages, marketing, and automated communications.
- Follow telecommunications, privacy, consumer-protection, employment, professional, and industry rules that apply to your use.
- Use human review and fallback processes for decisions or communications where errors could cause harm.
- Do not assume a feature satisfies regulated-industry obligations unless that requirement is expressly covered by your written agreement with Hello Alex.

## AI-assisted services

AI outputs can be inaccurate, incomplete, delayed, or unsuitable for a particular situation. The Services are not a substitute for professional judgment, emergency services, or required human review.

You are responsible for testing prompts, pathways, routing, integrations, and escalation behavior, and for monitoring the Services after launch. Do not use AI output as the sole basis for high-impact legal, medical, financial, safety, or eligibility decisions.

## Plans, usage, billing, and cancellation

- Plan prices, included usage, add-ons, taxes, trial terms, and billing intervals are presented at checkout or in the account.
- Subscriptions renew until cancelled. Cancellation takes effect as described in the account or checkout terms and does not erase charges already incurred.
- Usage-based charges can continue until associated services, phone routes, campaigns, or integrations are disabled.
- Except where law or an express written term requires otherwise, paid fees are non-refundable.
- We may suspend access for overdue balances and may change future pricing with advance notice appropriate to the change.

## Acceptable use

- Do not use the Services for unlawful, fraudulent, deceptive, harassing, abusive, or rights-infringing activity.
- Do not send spam or unlawful unsolicited communications, spoof identities, or evade consent and do-not-contact requirements.
- Do not attempt unauthorized access, interfere with service operation, distribute malware, or test security without written permission.
- Do not scrape, resell, reverse engineer, or use the Services beyond the rights granted by these Terms and your plan.
- Do not use the Services to place emergency calls or as the only method for time-critical safety communication.

## Content and intellectual property

You retain ownership of content you submit. You grant Hello Alex and its service providers the limited rights needed to host, transmit, transform, and otherwise process that content to provide, secure, support, and improve the Services.

Hello Alex and its licensors retain rights in the software, designs, documentation, branding, and underlying technology. Subject to these Terms and payment obligations, you receive a limited, non-exclusive, non-transferable right to use the Services during the applicable term.

## Third-party services

The Services may connect to telecommunications, payment, calendar, CRM, AI, and other third-party providers. Their availability, terms, data handling, and changes are outside Hello Alex's control. You are responsible for accounts and permissions you connect, and third-party failures may affect the Services.

## Availability and warranties

The Services are provided on an as-is and as-available basis to the extent permitted by law. We do not promise uninterrupted or error-free operation, that every call or message will complete, or that AI output will always be correct. Any warranties that cannot lawfully be excluded remain in effect only to the required extent.

## Limitation of liability

To the extent permitted by law, Hello Alex is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity arising from the Services.

To the extent permitted by law, Hello Alex's aggregate liability for claims related to the Services will not exceed the fees paid for the affected Services during the twelve months before the event giving rise to the claim. These limits do not apply where they are prohibited by law.

## Suspension and termination

You may stop using the Services and cancel through available account controls or support. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful use, provider constraints, or legal requirements. Provisions that by their nature should continue—including payment obligations, ownership, disclaimers, and liability limits—survive termination.

## Changes and contact

We may update these Terms by publishing a revised version and changing the date above. If a change materially affects an active paid service, we will use reasonable means to provide advance notice when practical. Continued use after the effective date means you accept the revised Terms.
